Affiliate Programme Terms

1. Programme Overview
The JomCard Affiliate Programme ("Programme") allows eligible participants ("Affiliates") to earn commission by referring new paying customers to JomCard. By participating, you agree to these terms in full.
2. Eligibility
To participate you must:
- Hold an active JomCard account in good standing
- Be aged 18 or over
- Not be an employee or contractor of Venari Solutions Sdn. Bhd.
- Comply with all applicable laws in your jurisdiction
3. How Referrals Work
Each Affiliate receives a unique referral link. When a new user clicks your link and upgrades to a paid plan within 30 days, that referral is attributed to you. Attribution is tracked via a first-click cookie that expires after 30 days. If the cookie is cleared or the user switches browsers, attribution may not be captured. Organic sharing means content you personally publish — blog posts, social media profiles, videos, or newsletters sent to your own subscriber base. Sharing via purchased email lists, scraped contacts, or platforms where you do not have an established audience does not qualify as organic.
4. Commission Structure
Affiliates earn 20% of each subscription invoice payment made by referred customers, for as long as those customers remain subscribed and the Programme is active. There is no cap on the number of qualifying referrals. Commission applies to:
- Pro monthly subscriptions
- Pro yearly subscriptions — commission paid as one lump sum per annual invoice
- Teams monthly subscriptions
- Future paid plans, if designated as affiliate-eligible, as announced
Commission does not apply to one-time credit pack purchases, free trials, or promotional pricing.
5. Payout Terms
Commissions are held for 7 days from the date of the invoice payment to allow for refund and chargeback resolution. After the hold period, commissions become eligible for withdrawal. Withdrawal must be manually requested from your Referrals dashboard — commissions are not paid out automatically. Payouts are made in your local currency — MYR for Malaysian referrers, SGD for Singapore referrers, and USD for international referrers. Withdrawal thresholds and processing times are displayed in your Referrals dashboard at the time of withdrawal. JomCard does not guarantee same-day processing. 6. Commission Reversals
A commission will be reversed if:
- The referred customer requests a refund before the 7-day hold period ends
- The payment is subject to a chargeback or payment dispute
- The referral is found to violate these terms (e.g. self-referral)
- Fraudulent activity is detected
7. Prohibited Activities
Affiliates must not:
- Refer themselves, family members, or accounts they control
- Bid on JomCard-branded keywords in paid advertising (e.g. Google Ads, Meta Ads)
- Send unsolicited messages or spam to promote their referral link
- Make false or misleading claims about JomCard's features or pricing
- Offer cash back or other incentives to referred users without prior written approval from JomCard
- Share their referral link via purchased email lists or scraped contact databases
8. Programme Changes, Disputes, and Termination
JomCard reserves the right to modify the commission rate, payout terms, or eligible plans at any time, with 30 days' written notice to active Affiliates. For these purposes, an active Affiliate is any Affiliate who has referred at least one paying customer in the preceding 12 months or who has a commission balance pending payout. Notice will be sent to the email address associated with your JomCard account — it is your responsibility to keep this address current. If you have a dispute about a commission calculation or payout, contact us at the email address listed below. We will respond and seek to resolve the matter within 14 business days before any formal action is considered. In the event the Programme is discontinued, any accrued commissions that have passed the 7-day hold period will be honoured. JomCard may terminate an Affiliate's participation immediately for violation of these terms, without obligation to pay pending commissions arising from prohibited activity.
9. Data and Privacy
To operate the Programme, JomCard collects and processes the following data about Affiliates: referral link activity, conversion events, commission balances, and payout details including bank account or payment method information. This data is processed for the purpose of calculating and disbursing commissions, preventing fraud, and complying with legal obligations. It may be shared with third-party payment processors solely for the purpose of executing payouts. This processing is carried out in accordance with our Privacy Policy and the Malaysian Personal Data Protection Act 2010 (PDPA). You have the right to access, correct, and request deletion of your personal data by contacting us at the address below.
10. Limitation of Liability
To the fullest extent permitted by applicable law, JomCard's total liability to any Affiliate arising from or in connection with the Programme shall not exceed the total commissions paid to that Affiliate in the 12 months immediately preceding the claim. JomCard is not liable for indirect, incidental, or consequential losses, including loss of anticipated commission income due to customer churn or programme changes made with proper notice.
11. Brand and Intellectual Property
JomCard grants Affiliates a limited, non-exclusive, revocable licence to use the JomCard name, logo, and approved marketing materials solely for the purpose of promoting the Programme through organic channels. This licence does not permit Affiliates to: modify JomCard's brand assets, imply official sponsorship or endorsement beyond participation in the Programme, or register domain names or social media handles containing the JomCard name. This licence is automatically revoked upon termination of the Affiliate's participation.
12. Tax Obligations
Affiliates are solely responsible for declaring and paying any taxes applicable to commission income under the laws of their jurisdiction. JomCard does not withhold tax on Affiliate payments. If you are unsure of your obligations, seek independent tax advice.
13. Governing Law
This Programme is operated by Venari Solutions Sdn. Bhd. (Company No. 202503204425), incorporated in Malaysia. These terms are governed by the laws of Malaysia. Any dispute arising from participation in the Programme shall be subject to the exclusive jurisdiction of the courts of Malaysia.
